The types of assumptions made are ontological,about nature of reality, epistemological about what can be known, axiological about what is important and valuable and methodological about methods, procedures allowable in a paradigm. Postulates are assumptions are assumptions specific to geometry while for mathematics assumptions are axioms as conditions that must be met for model to be valid. Brokers have been found to be investing on lobbying against privacy laws as in the case of data brokers and data sharing.

Lobbying is something different is not merely informational. Working of interest groups to effect policymaking and procuring favourable decisions in a resolution at stake yields a production function. A gain in value can be worked out. Brokers of power also use lobbyists who attempt to influence politicians, judges, members of regulatory agencies. Apparently this lobby also influences the elite. Lobbying is a controversial issue in representative democracy. It could be any communication with a legislator, bureaucrat or judge to influence decisions or policies. The legal system has not been able to incentivize lobbyists to identify them or to provide competing groups to have equal access to policy makers to further the ideals of participative democracy. Litigants seeking connected lawyers having ability to improve chances of the Court viewing the case as worthy has brought amicus briefs as an important tool of judicial lobbying. (www.yalejournal.org/forum/24 October 2021)The USA data provided in the Yale Law Journal about Supreme Court gives between 1946 and 1955 all opinions majority, concurring, and dissenting referred to amicus briefs in about 18℅ of amicus filers. In 1994 to 2003 referenced about 38℅ of the amicus brief filed and between 2008 to 2013 about it jumped to more than 606 times references in 417 courts opinions. Definitely effective lobbying of judicial branch is evident.

The caste lobbies, regional lobbies in appointment of judges through collegium system can wreath havoc. Commercial and advocacy groups being included in the definition of lobbyists to stop undue advantage or unequal access through secrecy is the need.

The ethics in influence peddling have been sustainable even in pre modern political system where influencing the monarch was needed. Advocacy turning into brokerage as intermediary activities blurs borders. The colonial legacy as well as control over information has turned India into legal backwaters. A recent study showed that Indian Supreme Court is not being cited in USA, Canada or UK but their Supreme Court decisions are copiously being fitted in Supreme Court of India decisions. Even nearby Pakistan does not rely on Supreme Court of India for its own reasons. The very notion of affirmative action being limited by USA Supreme Court in 2023 in race related admission policies in some Universities reversed decades of precedence. Could the Indian Supreme Court do such a thing?

Further the paradox arises where the elite has a rational emulation and deviance arises when individuals care about relative position of status. In trying to be different from the rest they find it rational to imitate other people . Having deviated in rational choice setup the experience of deviance and its incentive is an economic deviant behavior rather than criminal or social deviant. Lobbying turning to bribery or extortion is not unknown.The people who know how to use The system or averse to seeing it change as it would reduce their gains.In 2013 a commercial firm registered itself as a company by the name of Social Sector Research Consultancy & Support Services( India) Private Limited. It changed its name to Amnesty International Private Limited in 2015 and also formed another company Amnesty International South Asia in New Delhi. It was only in 2019 that the frauds including money laundering was caught by Government Agencies. The link of multinational NGO’s with illegal funds wreathing havoc in India came to light. The alleged link of Ex Indian Administrative Service Officer Harsh Mander with Action Aid Foundation with funds from Sierra Leone for missionary activities and Open Society Foundation and Center for Equity funded by George Soros revealed some deeper manipulation by NGO’s in Indian polity and fighting cases for terrorists in the Supreme Court of India.This Harsh Mander also served as the Special Commissioner to the Supreme Court of India in Right to Food Campaign in an independent structure. He was also made member of the National Advisory Council under the UPA government, he was nominated and shortlisted for Nobel Peace Prize 2022 from Oslo(vu.nl/en/news/2022) in an Agenda driven move. The Nobel Peace Prize is apparently working in a propoganda promoting system.

The January 2018 press conference by four judges of the Supreme Court of India against Chief Justice Dipak Misra and then next Chief Justice, Ex CJI Mr. Justice Ranjan Gogoi’s outburst that a lobby is holding Judiciary to ransom.This CJI Dipak Misra was the same judge who ordered that CBI Judge Brijgopal Harikishan Loya’s death in 2014 was a natural death and seeking inquiry in his death was an attack on the independence of the judiciary.The 2018 incident brought to the forefront the disproportionate powers of the Chief Justice of India and being beyond just first among equals and having administrative powers.

The power to list and allocate cases to benches in the backdrop of unknown criteria or factors that the CJI must consider while forming a Constitution bench or allocating cases to that Bench raises questions. The changing role and function ( SCO, 27/10/2023} with number of judges increasing, who’s sits on the bench becomes important. The CJI is more likely to be on the bench and apparently never in minority view as per data available. Since 1980, in 1532 odd Constitution benches cases, in dissent only 9 times. On the other hand Mr.Justice N. V. Ramanna as CJI did not form Constitution Benches at all while Mr. Justice D Y. Chandrachud is overenthusiastic about them.

Crowd management and popularity notions depend on emergent norms in a convergence as a collective mind leading to more intensive individual behaviour can be instantaneous. Predicting and controlling this behaviour to effect collective wisdom makes some assumptions about quality of the crowd. Common emotions like fear, anger,rage getting intensified in increasing concentration of attention with anonymity being available can easily be manipulated and provoked.Clogged with backlog of cases and burgeoning pendency of cases, there is no time management in the courts. Judicial pronouncements could easily be populist in a manipulation. Outwardly it may appear to be safeguarding impartiality and objectivity, it is a legitimacy crisis.
